Terms of Use and Sale
Version 1.5 — effective October 9, 2026
Language. This English version is provided for convenience. In case of any discrepancy between the English and French versions, the French version prevails.
1. Publisher
GOSKEN S.A.S., a simplified joint-stock company (sociedad por acciones simplificada) incorporated under Colombian law NIT 901584640 Registered with the Medellín Chamber of Commerce Registered office: Medellín, Antioquia, Colombia Contact: the website's contact form Data protection officer: dpo@gosken.com
The service is hosted by Vercel Inc., 440 N Barranca Ave #4133, Covina, CA 91723, United States. The database is hosted by Neon Inc., United States.
2. Purpose
My Trading Book (the "Service") is online trading journal software. It lets the user record their trades, annotate them and compute statistics on them.
The Service is a record-keeping tool. It places no orders, manages no capital, holds no funds, and has no access to any brokerage account beyond reading the history the user chooses to send it.
3. Analysis content
The Service may give access to market analysis written by the publisher.
This content is provided for information and educational purposes only. It is hypothetical, takes no account of any reader's particular situation, and constitutes neither financial advice, nor an investment recommendation, nor an inducement to buy or sell any asset.
The author may hold positions in the instruments mentioned.
Access to this content does not depend on taking out a paid subscription. It is not part of the services sold.
4. Account
Access requires creating an account, opened by taking out a subscription or through a personal invitation.
The user guarantees that the information provided is accurate and undertakes to keep their credentials confidential. Any action carried out from their account is deemed to have been carried out by them.
The user must be of legal age and have the legal capacity to enter into a contract.
An account is personal. Sharing, reselling or transferring an account is prohibited. At most two sessions may be open at the same time; beyond that, the oldest one is closed.
5. Use of the Service
The Service is provided for personal and reasonable use. The following are prohibited in particular: automated access not provided for by the publisher, mass extraction of data, repeated requests intended to overload the servers, attempts to bypass access controls, and any use that hinders the operation of the Service for other users.
Data sent by the expert advisor is subject to rate limits. Repeatedly exceeding them may lead to the suspension of the key concerned.
The publisher may suspend or close an account, without notice and without refunding amounts corresponding to services already provided, in the event of a breach of these terms, abusive use, fraud or non-payment. Suspension ends the current subscription; amounts corresponding to the unused period are refunded.
6. Subscription, price and payment
The Service is offered on a monthly or yearly plan, at the prices shown on the website at the time of subscription.
A free fourteen-day trial is offered when the account is created. It starts at the first sign-in, not at registration, and requires no payment method. At its end, access closes: the subscription only starts if the user takes it out.
Access granted free of charge — by invitation, as a commercial gesture, or as a complement offered alongside a subscription — is not a subscription. It is not billed, does not renew, gives rise to no refund, and the publisher may close it at any time. The right of withdrawal under section 7 has no object in respect of it, since nothing has been paid.
Payments are processed by Paddle.com Market Limited, which acts as merchant of record: it collects payments in its own name, collects and remits the applicable taxes, and issues invoices. Its terms apply to the transaction, in addition to these terms.
The subscription renews automatically for the same period, unless the user cancels it before the renewal date.
7. Cancellation and refund
The user may cancel at any time from their account. Cancellation takes effect at the end of the current period, without a pro rata refund.
Right of withdrawal. A consumer user has fourteen days from subscription to withdraw and obtain a full refund, whatever their country of residence. This period applies even where local law provides for a shorter one, such as the five business days of the Colombian consumer statute (Estatuto del Consumidor), or provides for none for a digital service.
Withdrawal is exercised through the contact form. The refund is issued by Paddle.com Market Limited, which collected the transaction.
After this period, cancellation takes effect at the end of the current period, without a pro rata refund.
The end of a subscription deletes no data. The user keeps access to their account and may export their data at any time, as section 10 provides, or delete it themselves. The period after which an account left with no open access and no sign-in is deleted is set out in section 8 of the Privacy Policy.
The publisher may terminate an account in the event of a breach of these terms, after a formal notice that has remained without effect for fifteen days, or immediately in the event of fraudulent use.
8. Availability
The publisher uses reasonable means to ensure the availability of the Service, without any guarantee of continuity. Interruptions may occur for maintenance, updates, or because of third-party providers.
Some features depend on external sources: exchange rates, economic calendar, brokerage platform. Their unavailability does not engage the publisher's liability.
9. Liability
The Service is provided as is. The publisher does not guarantee that it is free of errors.
The user remains solely responsible for their trading decisions and their consequences. The publisher cannot be held liable for financial losses incurred on the markets.
The user is responsible for complying with the conditions set by their broker or proprietary trading firm, in particular regarding the use of automated tools that read trading history.
The publisher's liability, for all causes combined, is limited to the amount paid by the user during the twelve months preceding the event giving rise to the claim.
These limitations do not apply in the event of intentional deception, gross negligence, or to the extent that the applicable law prohibits them.
10. Intellectual property
The Service, its code, its interface and its analysis content are the property of the publisher.
Data entered or imported by the user remains their property. They may export it at any time from their account.
The user shall not reproduce, decompile or redistribute the Service, nor publicly redistribute the analysis.
11. Personal data
Data processing is described in the Privacy Policy, which forms an integral part of these terms.
12. Changes
The publisher may amend these terms. Users are informed at least thirty days before a new version comes into force. Continued use after that date constitutes acceptance. Otherwise, the user may cancel free of charge.
13. Governing law and disputes
These terms are governed by Colombian law.
Any dispute falls under the jurisdiction of the competent courts of Medellín, Colombia.
Mandatory provisions protecting the consumer in their country of habitual residence remain applicable where they are more favourable to them.
