A Colombian company: what protections do you have?

GOSKEN S.A.S., the publisher of My Trading Book, is a Colombian company based in Medellín. Here is what that means for you in practice, and the protections you have.

An identifiable company

GOSKEN S.A.S. is a simplified joint-stock company (sociedad por acciones simplificada) under Colombian law, registered with the Medellín Chamber of Commerce under NIT 901584640. Its details and legal documents are published on the site, and its terms are governed by Colombian law.

Your data: Colombian law, and the law of your country

Colombia regulates personal data protection through Law 1581 of 2012, which is built on the prior authorisation of the person concerned and guarantees their right to know, update, rectify and delete their data. Compliance is supervised by the Superintendencia de Industria y Comercio, with which you can file a complaint.

If you live in the European Union or the United Kingdom, the GDPR also applies, and you can turn to your country's data protection authority. Residents of US states whose laws provide for it, including California, have the rights granted by those laws. Where several laws apply, the most protective rule prevails.

In practice: your trading data is neither sold nor shared for advertising, and you can export all of it and delete your account at any time from your profile, without asking anyone.

As protective as in Europe?

The principles are very close. In Colombia, data protection is a constitutional right, the habeas data of Article 15 of the Constitution, and Law 1581 of 2012 rests on the same foundations as the GDPR: a defined purpose, prior consent, security and confidentiality of data, and your rights of access, rectification and deletion. The Superintendencia de Industria y Comercio actively supervises and sanctions, with fines of up to 2,000 monthly minimum wages.

To be precise, though: the European Union has not issued a decision recognising Colombia as offering equivalent protection, as it has for Argentina or Uruguay. But that changes nothing for you if you live in Europe: the GDPR applies anyway to a company offering its services to European residents, wherever it is established. You therefore keep all your European rights, and GOSKEN applies the most protective rule where several apply.

Your payments: a recognised merchant of record

Subscriptions are sold by Paddle.com Market Limited, a UK company acting as merchant of record. It collects the payment and your country's taxes, and issues your invoice. GOSKEN never sees your card number.

Your consumer rights

You have fourteen days after subscribing to withdraw and get a full refund, whatever your country. That is more than the five business days provided by the Colombian consumer statute.

Above all, the mandatory rules protecting consumers in your country of residence still apply where they are more favourable to you. The choice of Colombian law cannot take those protections away.

And security?

Two-step verification offered to every account and strongly recommended, passwords and API keys stored as hashes, encrypted connections. The site and the database are hosted in the United States, with Vercel and Neon, under contractual clauses governing these transfers.

All of this is detailed in the privacy policy and the terms and conditions. For any question, the help page remains the most direct way to reach us.

GOSKEN builds financial tracking software: a trading journal, and wealth tracking.
